Filed a ch 13 and things were going well. Husband then lost job and payments were unable to be kept up. We were told to try and make payments. I and my law firm do everything possible to help clients through the difficult times that occur within the life of a Chapter 13. This includes maintaining open lines of communication with the client at all times. If a debtor falls more than two monthly payments behind, the Chapter 13 Trustee may file a Motion to Dismiss for failure to maintain payments. If a dismissal is filed, The Fealy Law Firm, P.C. sends a letter to the client which is followed up by an email and a phone call to discuss options and make sure the client is aware of the dismissal hearing. If there is a change in circumstances during a Chapter 13 plan, a modification may be filed to catch up on delinquent payments in certain situations. Unfortunately, a plan can only be modified if there is sufficient income to fund the modified plan. This is something I discuss with each client in their initial consultation as well as anytime the problem arises during a Chapter 13 plan. Clients are always welcome to schedule an appointment with me if they have any questions regarding their case. I pride myself on accessibility to clients. Every client phone call is taken or returned. The Fealy Law Firm, P.C. has a 24 hour policy on returning phone calls. All phone calls must be returned within 24 hours unless it is a week-end call, then the call is returned first thing Monday morning. In most instances, phone calls are taken immediately as the office is fully staffed between 8:30 a.m. and 5:30 p.m.
