Sep 08, 2006OUTCOME: The AAO approved my certified case which had national impact helping thousands of teachers all over the U.S. qualify for a cap-exempt H-1B as specialty occupation workers.
The case was certified to the Administrative Appeals Office (AAO) to determine: 1) whether an elementary teacher enrolled in an alternative certification program qualified as specialty occupation worke ... r and thus eligible for an H-1B; 2) whether petitioner, an independent school district, had qualifying relationships to exempt it from the H-1B cap through an affiliation with an institution of higher education.(AAO Sept. 8, 2006)
