This was an action brought against Michigan Industrial Holdings, Inc. and its principal shareholders, for an alleged violation of the Worker Adjustment and Retraining Notification Act ("WARN"). Specifi ... cally, it was alleged that Defendants closed a manufacturing facility in Jackson, Michigan without giving the 60 day requisite notice under the WARN Act. Defendants argued that statutory exceptions to the 60 day notice requirement existed and therefore, a motion for summary judgment was filed seeking dismissal of the case. The Defendants' summary judgment motion was granted at the Federal District Court level. Plaintiffs appealed the dismissal to the 6th Circuit Court of Appeals. After submission of written briefs and oral arguments the 6th Circuit Court of Appeals affirmed the decision of the Federal District Court and the dismissal with prejudice was affirmed.
