The client was charged under MCL 333.7401(2)(d)(iii) for possession wit ... h intent to deliver marijuana. Core Legal attorney, Christopher Wirth successfully argued what Fox News called the first challenge in the State of Michigan under the U.S. Supreme Court's Riley v California decision. (For more on the impact of Mr. Wirth's motion and argument click here) The client faced up to 6-years in prison and $20,000 in fines because of an alleged second felony habitual offender count. After the court granted Mr. Wirth's motion to suppress cell phone evidence, the felony case was dismissed and the client pled guilty to misdemeanor possession of marijuana. At sentencing, Mr. Wirth successfully advocated for his client's misdemeanor plea to be deferred under MCL 333.7411. Because of this section 7411 deferral, the client's driver's license will not be suspended for the 1-year mandatory sanction for drug crimes and, upon the client's successful completion of the 12-month probation, the client's entire case will be dismissed and removed from his criminal record.
