On November 26 2001, Dondi's client, then 15 years old, was travelling as a passenger in a motor vehicle being operated by his mother, on South Boulevard near the ramp for eastbound M-59 in Rochester H ... ills, when they were involved in a very serious collision with another motor vehicle that t-boned them. As a result of the accident, his client was diagnosed with a traumatic brain injury and has been receiving 24 hour a day attendant care from his parents and has been to multiple doctors visits and therapy, including a vocational workshop and group home. At the time of the accident, he was insured under his parents auto insurance policy.. Thus, such insurer is responsible for his Michigan No Fault benefits such as payment of medical expenses and attendant care. The insurer had denied payment of any such benefits in this case.

Dondi settled a lawsuit on behalf of our 73-year-old client against the at-fault driver and no-fault insurance company for injuries he sustained and loss of benefits he incurred due to serious injuries ... in an Oakland County motorcycle accident. The accident occurred in Ferndale when the operator of a BMW motor vehicle negligently made a right turn off of Grodan Road directly into the path of client’s motorcycle, which had been lawfully travelling on Telegraph, causing our client’s motorcycle to go down and resulting in his body impacting the motor vehicle in an effort to avoid a collision. Our client suffered serious injuries in the accident. Our client’s injuries included multiple rib fractures, clavicle fracture, a significant hematoma on his hip, pneumothorax, pulmonary contusion, atrial fibrillation, and broke all his teeth. He required a lengthy hospital stay followed by approximately 3 weeks of in-patient rehabilitation and approximately 2 months of in-home visiting nurses. His treatment included physical therapy, draining of the hematoma, and needed false teeth put in. The injury also left him with a noticeable drop of his left shoulder of about 4 inches. Medical records, police reports, photographs, and other documentary evidence was gathered, and depositions were taken, including those of our client, his wife, the at-fault driver, and the no-fault insurance adjuster. Also, discovery was exchanged between the parties. We reached a settlement in the claim against the at-fault driver in the amount of $215,000.00. The case against the no-fault insurance company settled for $30,000.00, which encompassed the entirety of the benefits that had remained unpaid by then no-fault insurance company.
