LaGrow v Berrien County et al.
Dec 11, 2008OUTCOME: Granted summary judg. at trial; affirmed on appeal
Plaintiff asserted multiple claims related to unlawful discharge from employment, including gender and disability discrimination and retaliation, after she resigned in lieu of termination from her empl ... oyment as Economic Director of the County. After a couple meetings to discuss concerns with Plaintiff, including potential conflicts of interests, and using County time and position to promote separate business interests, Administrator informed Plaintiff that should would be terminated. Plaintiff requested to resign in lieu of termination, which Administrator accepted. County affirmed acceptance of resignation. Plaintiff later tried to rescind her resignation, which the County declined. Because Plaintiff voluntarily resigned, the trial court and Court of Appeals held that her claims were precluded as a matter of law.
