People of the State of Michigan v Jamal Chambers, et. al.
Mar 18, 2010OUTCOME: Chgs reduced from 15 yr felony to misdemeanor
3 defendants charged with Breaking & Entering a Building, with a possible 15 year prison sentence. After discussing the matter with my client & visiting the scene of the crime I insisted on holding a p ... reliminary exam for my client & the other 2 defense attorneys went along. After the witnesses testified, I argued that there was no probable cause that any of the defendants committed a felony as the evidence showed that anyone could walked into the building and no one saw any of the defendants even do that. The Judge reduce the charges for all 3 to a misdemeanor & gave all the defendants credit for time served & closed the case without any further penalties. If I hadn't visited the scene & insisted on a preliminary examination, my client would have been bound over to circuit court to face a felony trial where anything could have happened including a severe prison sentence if convicted.
