You could get a deferred probation, which on a class C ticket would be easy and short. Then you could get it off your record

With straight probation, it's up to the judge whether or not to set a bond.

If he was in a car, it will be charged as a state jail felony offense, punishable by up to 2 years in state jail

Whether or not you plead or go to trial is up to you. Your lawyer can counsel and advise you, but it's your decision.

If you were tried for capital murder, you cannot be tried again for that same crime. That is called double jeopardy. your appeal won't change this...

Unfortunately it will show up until you get it nondisclosed, which will take place 5 years after you've completed deferred probation
