Contractor brought action against subcontractor for breach of contract and declaratory relief, and subcontractor counterclaimed for breach of contract and declaratory relief. After a jury trial, the Di ... strict Court, City and County of Denver, held that subcontractor breached contract and denied subcontractor's motion for judgment notwithstanding the verdict or, in the alternative, a new trial. Subcontractor appealed. The Court of Appeals held that subcontractor's designated record complied with appellate rule governing requirements for record on appeal, but vacated jury's decision and remanded case on ground that evidence did not support the verdict. Contractor petitioned for certiorari review.
