client paralyzed after being struck by vehicle that was not insured but had attached an "in-transit" plate from muffler shop. Shop was not the registered owner but suit claimed the business was a "de ... facto" owner under owners liability statute as a result of its plate being attached. Case of first impression that was vigorously defended by business insurance carrier. Trial court agreed, Ct. of Appeals agreed and Supreme Court affirmed.
