Live-in girlfriend brought suit against decedent's estate for reimbursement of hundreds of thousands of dollars of purported household expenses. No contract existed between the parties, nor did decede ... nt choose to provide for her in estate planning documents. Plaintiff relied on equitable theory of unjust enrichment. Michigan law states that that unjust enrichment claims may not lie between parties that live together as to do so what revive common law marriage, which was abolished by the legislature in the 1950's. Filed motion for summary disposition on behalf of estate for failure to state a claim.
