OUTCOME: Jenkins successfully defended an Appeal to the Fifth Circuit of a pre-trial dismissal of case alleging FDCPA, TDCPA, and DTPA claims.

Debtors filed federal case claiming violations for debt collection practices. The Fifth Circuit noted that the history of collection efforts did not constitute false, fraudulent, or deceptive collection techniques, and agreed with the District Court that the debtors failed to allege facts sufficient to support their allegations of improper debt collection practices. The Judgment dismissing the claims was affirmed.

OUTCOME: Successfully obtain unanimous jury trial verdict for an employee whose pay was improperly cut and the Court of Appeals affirmed the verdict. 270 S.W.3d 695, 706 (Tex. App.-Dallas 2008, no pet.)

After a two-day trial that resulted in a unanimous verdict, the jury rejected employer's four defenses and found in favor of Jenkins' client. Court of Appeals affirmed award.
