My Opinion of Attorney Alan Wittenberg is that He is a VULTURE and DISHONEST.

I had been calling various landlord/tenant attorneys to check their consultation fee. I called Attorney Alan Wittenberg who told me his fee was $100.00. He said he could schedule me for the next day at 10 am. He immediately asked for my credit card number and I provided it. He never told me that he w...ould charge me 'immediately' leaving me no room to cancel if I needed to. The call was made to the Attorney at 2:26 p.m. on 3/28. At 2:31 p.m. the Attorney charged my card. At 2:39 p.m. the Attorney sent me the Fee Consultation Form to Sign. At 3:13 p.m. I sent my first document to the attorney to review the next day which was the lease. At 4:54 p.m. I realized I would not need this attorney's consultation so I emailed him to cancel it. No response. At 6:33 p.m.I called the Attorney and advised him I no longer needed the consultation. He immediately told me that I would not get a refund. His stated that he had already begun reading my lease and that this was the 'only reason he charged me'. The Attorney, according to my records, WAS NOT HONEST. The Attorney charged me right after my call ended. I was charged the fee at 2:31 p.m. and my first document did not come over to him until 3:13 p.m. The Attorney did not even follow his own Fee Consultation form because the form stated that 'no professional services would be rendered until both the fee is paid and the form is signed'. The form was not signed or submitted. And he charged the fee as soon as I hung up with him. I believe this Attorney requests the credit card info up front on every call and people are charged immediately for services without the option to cancel and before the service is even rendered.

I regret Ms. Summers feels she is not being treated well. However, she has not been entirely truthful. While her timelines are fairly accurate, I specifically informed her after taking her credit card information at 2:31 p.m. that I was about to submit the charge before doing so, and she agreed. At no time did she indicate she might change her mind nor cancel the consultation and there was never any discussion of my waiting to charge her card or to review her documents. What she did do was send ten pages of documents right away for me to review before our 10:00 a.m. consultation the next morning. I did not see the email she sent me after hours, but even if I had, I had already spent my time reviewing those documents she sent me. My next contact with her was by telephone at approximately 6:30 p.m. that evening. By that time I had already expended my time to review her documents and prepare for the consultation. When she informed me she wanted to cancel the consultation, I explained that she had paid for my time to review her documents and there was no refund available. I informed her that had she not sent the documents for me to review she would have been entitled to a full refund. However, she did not consider that by sending them, she was obligating me to do work for her prior to the telephone conference. At that time she stated she would go ahead with the consultation. I left that time slot available for that consultation and could not schedule another in that time. When I called and emailed her at the appointed time, she did not respond. I suppose she feels that she should not be obligated to pay for services she requests.
