He is eligible for probation. The BMV's were misdemeanors. It will be a good defense lawyers job however to actually get him probation.

Can the owner file charges with out having proof. No pictures or statements were taking the day of the incident.

They can file a charge, but the police may not file the case once he looks at the facts.

They can file criminal charges against you. The fact that it was returned has no effect on the charges.

Not necessarily. As long as your attorney drafted, filed and did the hearing properly, the response should come fairly soon.
