Plaintiff claimed he was injured while utilizing a scissor lift, 25 ft above the ground while installing air conditioning ducts that each weighed 50 to 60 lbs and were 32” wide and 68”long. Plaintiff c ... laimed a malfunction or other circumstances caused lift to rise unexpectedly which caused him to take evasive actions to avoid being smashed against a duct when the entire lift fell over which caused Plaintiff to sustain serious injuries including fractures to two vertebrates and his left hip. As a result of the incident in question, Plaintiff claimed he suffered disabling injuries to his head, spinal cord, hip, vertebrates and other portions of his body, mental and physical functioning, etc. Purportedly had over $100k in past medical expenses. Demand was $2 million.

Plaintiff made a demand on his own underinsured motorist policy issued by Nationwide for the limits of $100,000. As a result of the accident in question, Plaintiff claimed injuries to his low back and ... neck. He asserted past medical expenses of $20,000 and claimed he could no longer play golf, or participate in numerous sporting activities since the accident including hockey, skating, football, basketball, baseball, and tennis. He claimed in deposition he could no longer play these sports with his son as well. He sued Nationwide for breach of contract and various extra-contractual allegations including violations of the Texas Insurance Code.
