Tobias Moon's national regulatory practice focuses on compliance with federal and state requirements related to originating and servicing loans secured by residential real property and automobiles. He regularly counsels lenders, servicers, investors, and settlement service providers with regard to compliance with various federal statutes and regulations including RESPA/Regulation X, TILA/Regulation Z, ECOA/Regulation B, HMDA/Regulation C, and UDAAP. In addition, Tobias advises consumer financial services companies on complying with CFPB rules and exam readiness.
Tobias also advises clients with regard to compliance with state lending and servicing statutes and regulations. He has experience preparing 50 state surveys summarizing licensing requirements, advertising restrictions, disclosure obligations, permissible fees and charges, record retention requirements, telemarketing, usury limits, and foreclosure considerations.
Tobias assists clients with complying with the seller/servicer requirements set forth by Fannie Mae and Freddie Mac as well as the requirements set by insurers such as the Federal Housing Administration and the U.S. Department of Veterans Affairs.
Prior to joining Akerman, Tobias served in leadership positions with major U.S. banks for more than six years where he gained practical legal experience in addition to leading compliance and risk management teams. At Countrywide Financial Corporation/Bank of America, he served as an in-house counsel on a variety of mortgage servicing, default, and loss mitigation issues. Additionally, he ran a team of imbedded risk managers that managed the regulatory risks associated with credit, flood, title, and valuation products. While at Citi, Tobias managed the mortgage originations compliance testing team. At Capital One, his team managed the legal and compliance risks associated with the home loans and auto businesses.
