Client blew in the Intoxilyzer 5000 at the station a .14. He admitted to drinking alcohol, and was also arrested for a previous cocaine possession charge he had an existing warrant for. I set the cas ... e for a hearing on a motion to suppress the evidence that an illegal stop was made. The arresting officer failed to show up 3 different times for the hearing. Had he shown up, I am still confident I would have prevailed just the same. We had a flawless issue, and the law was completely on our side given our specific facts with what the rules are when initiating a traffic stop based on a violation of having "dim" tail lights.
