In Texas, when you file the complaint, the summons is taken care of by the clerk of the court. Florida may be similar.

I don't know that it is illegal. He would have a hard time proving his case in court if he destroyed the records. It would be your word against his.

I would get with a local attorney. Timing is important. You can terminate this lease at expiration and have tenant sign a new one.
