Unethical behavior

I sold a house a few years ago. Mr. Kimble represented the buyer. About a month after closing, I noticed that my bank account was still automatically being debited for my previous monthly mortgage payment. I reported this to Mr. Kimble's law firm. They corrected this error, but only agreed to reimbur...se me for the mortgage payment and not the interest charges. I followed up directly with Mr. Kimble requesting an explanation. Repeated attempts to contact Mr. Kimble were unsuccessful even after leaving multiple messages with his secretary asking him to contact me. After three months, I finally got Mr. Kimble on the phone and requested an explanation of why I was responsible for covering the interest costs since I had paid his firm courier fees at closing to ensure the final payment was delivered. He stated that it was my responsibility to check that his firm's courier had delivered the payment. When I insisted that it should have been his firm's responsibility to ensure their courier had delivered the payment, he then said that it was his company's policy that they do not pay interest charges if a courier makes an error. When I asked to see a copy of the policy, he then stated that it was an internal policy that he could not share. When I continued to request his firm should cover all costs, he responded by saying that I should be happy since I made a profit on the sale of my home. I told him that my profit was less than it should have been because I was stuck paying interest charges for a mortgage payment AFTER closing due to an error caused by the courier his firm employed. I asked him to please reconsider paying the interest charges and get back to me. He promised he would; I never heard from him again. I was not reimbursed for the additional interest charges incurred because his firm's courier failed to deliver the final payment.

Avvo Rating

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
