His punishment range was 15 years to life in prison. The State's offer was to plea to prison time. Defendant, believed he was finally turning his life around and wanted probation. Johnny Lanzillo set the case for an open plea to the court in Criminal District Court 4. Upon hearing the plea, Johnny successfully argued to get the defendant probation, even though he had already collectively served over 30 years in prison for a collection of charges that included sexual assault, stalking, and failure to register. If successful on probation, client will never step foot in prison for this most recent felony charge.

Client fled in his vehicle the detention of a Texas state trooper. He was caught about 30 minutes later while attempting to evade Addison PD on foot. Addison catches him, finds a weapon, xanax and weed ... , and hits him with 4 misdemeanor charges. State trooper sends his report in and DA files felony evading with a vehicle and a 2nd pot charge for what was in the vehicle. Client was appointed attorney, who plead him to time served on the 4 Addison misdemeanors. A few months later, picked up on the indicted felony. He hires our office. After reviewing the discovery. I file a Special Plea of Double Jeopardy on the Felony Evading, DA's office argues it is 2 transactions based on case law out of Tyler. I argue 1 transaction, and double jeopardy applies based on a case out of Corpus Christi. After receiving briefs and argument, and consulting with their appellate attorney, the Judge granted the special plea of double jeopardy on the felony charges. The case was dismissed, and the attached misdemeanor was also dismissed.

After reviewing the Motion to Suppress, the DA agreed to drop the charges entirely. The case was dismissed and Client will be eligible for a complete expunction of this arrest and charge from his record.
