OUTCOME: summary disposition for plaintiff upheld on appeal
This was a dispute between an Estate and a Trust over ownership of a brokerage account worth more than $1.5 million. I represented the Estate and won summary disposition. The Trust appealed to the Mi ... chigan Court of Appeals, and we won again. The case was appealed againt to the Michigan Supreme Court and we won again. The issue involved was whether a joint account was legally property of the Trust, where the trust creator did not properly transfer the account into the trust. As such, the joint brokerage account agreement controlled, and the surviving owner of the account (and ultimately her Estate) was determined to be the proper owner.
