Transfer your H1 as soon as possible. There are repercussions ifg the employer is violating H1B regulations. Your petition could be revoked.

Generally, If you overstayed your visa you may be barred from returning for atleast 3 years without a waiver.

It is unlikelty you will get approval before your stay expires and Customs will go by what documents you have such as an I94 or visa or DS 2019
