If your spouse is a US citizen and you overstayed your visa this should not be a problem. We would need more information.

You can renew your visa 6 months in advance. Consult an attorney as if you are not in a true management position as opposed to doing daily tasks it...

You can only file a 485 application through your mom if you have an approved I 130 petition for alien relative through your mom.
