Porzondek v City of Saugatuck, City et al. US FED MWD 1:16-cv-00777
Oct 11, 2017OUTCOME: Case resolved after depositions and mediation.
The case involved constitutional right violations including due process and expression by the historic district commission. The case was filed by Mr. Haddock in the United States Federal Court for t ... he Western District of Michigan. The case spent years in and out of Allegan County Courts that did not recognize the municipalities lack of authority to regulate a residential awning. Plaintiff sought to keep an awning on their home and for the municipality to cease writing violations and otherwise interfering with plaintiff's quiet enjoyment of their home as they designed it. A resolution was reached after the depositions of the plaintiff and defendant(s) prohibiting further enforcement by the Historic District Commission and allowing the awning to stand. The city employees and Mr. Prozondek were actively involved in the resolution of the matter.
