In The Matter of Rebecca Clemence
Dec 06, 2017OUTCOME: objecting sibling's claims were dismissed as no proof of either of their claims were substantiated
This case involved 4 siblings who received a specific share of an Estate upon the death of their surviving parent (mother). When their father passed, the surviving parent drafted her will/trust, leavi ... ng the home to one daughter, plus 70 % of the liquid assets in the Estate. The 3 other siblings objected to the terms of their mother's will, where each would receive 10 % of the remainder of the Estate. The objecting siblings claimed that their mother must have lacked the mental ability to prepare her will or that she was under the improper influence of another.
