Jun 29, 2011OUTCOME: I won the appeal. The trial court's decision was reversed. Following the appeal, I was able to negotiate a favorable settlement for my client.
I represented Plaintiff Tulane University Hospital and Clinic against the Defendants, who were an injured worker's employer and workers' compensation carrier. The injured worker sought medical treatmen ... t at my client's facility for his work-related injuries. The Defendants asserted that our claims for medical payment and penalties and attorney's fees were untimely. The workers' compensation court ruled in favor of the Defendants and dismissed our claims. I successfully appealed this adverse ruling to the Fourth Circuit Court of Appeal. The case citation is 70 So.3d 988 (La. App. 4 Cir. 6/29/11).
