The decision provides a way for uninsured Texans to negotiate high hospital bills under similar circumstances.

On appeal of a favorable ruling for our client, the trucking company attorneys argued that discovery of the truck driver's medical history falls outside the scope of Rule 192.3 because his medical cert ... ifications already have been provided to Plaintiff. The appellate court found that just the fact that the truck driver may have been medically certified to drive does not necessarily mean that there is no other information in his medical history that may bear on the litigation. Plaintiff alleged that the truck driver was not qualified to operate a tractor-trailer under applicable federal regulations as part of his claim of negligence against the defendants. Negligence has long been defined as doing something that a person of ordinary prudence under the same or similar circumstances would not have done, or, conversely, failing to do something that a person of ordinary prudence under the same or similar circumstances would have done. The court held that if the truck driver had a disqualifying condition as suggested by Plaintiff, that was not disclosed in connection with his medical certification, that could be germane to whether any of the defendants acted with negligence. Therefore, the trucking company did not demonstrate that discovery of the truck driver's medical records is outside the scope of permissible discovery.

Plaintiff claimed that YK Man agreed before the moratorium to renew Plaintiff's policy but failed to properly submit the application. Plaintiff sued for negligence, negligent misrepresentation, Texas DTPA violations, breach of contract, breach of fiduciary duty, and insurance code violations. Jury found for negligence, gross negligence, negligent misrepresentation, breach of contract, and breach of fiduciary duty.

On or about September 13, 2008, Hurricane Ike damaged a 60,000 square foot hotel in Nederland, Texas owned by Plaintiff. Plaintiff filed a claim with TWIA which denied the claim on the basis that the ... hotel was not covered by windstorm insurance at the time. Plaintiff's insurance agent was Khan. Plainitff claimed that Khan represented that Plaintiff could obtain windstorm coverage from TWIA. Plaintiff sued TWIA and Khan for negligence, negligent misrepresentation, fraud, Texas DTPA violations, Texas Insurance Code violations, and breach of fiduciary duty. According to Plaintiff, Khan failed to properly submit an application for windstorm insurance coverage with TWIA. The case was set for trial on May 3, 2010. The defendants' experts were limited from providing any expert testimony. Plaintiff nonsuited TWIA before it filed an interlutory appeal on its denied plea in abatement.
