Our client (BK) was charged with two felonies consisting of drunk driving third offense and possession of methamphetamine. The offense of possession of methamphetamine has a potential maximum sentence ... of 10 years in prison. Our client dusted off, got back on his horse and began a substance abuse treatment program. The prosecutor granted our deviation request to reduce both felonise to misdemeanors. Based upon the judge's decision, our client received probation and no jail and no felony record. This case was handled in Roseville on August 24, 2022.

A person convicted of OWI with a high BAC is suspended for 45 days (no driving) followed by 320 days on a restricted license with the BAIID ... device installed on vehicle. BAIID is the breathalyzer ignition interlock device. He was in an accident and his blood work came back extremely high. Getting an HIGH BAC .17 OWI down to impaired is considered a victory. In my client's case, we fought to get a non-criminal offense and succeeded.
