OUTCOME: Case Dismissed. Affirmed by Court of Appeals

A condominium development sued co-owner Peraino claiming that her installed fence did not conform to the bylaws. Mr. Aloia represented Mrs. Peraino and was able to convince the Court to dismiss the ca ... se because the Association lacked standing to sue. The Association was required to obtain a 66 2/3 approval of its co-owners before it hired a lawyer and sued Mrs. Peraino, but failed to do so.
