Operating While Intoxicated 3rd Offense in Oakland County where the client was pulled over leaving the bar on the night of the Superbowl for making an illegal turn. The client had a blood alcohol cont ... ent over the legal limit and the Clawson police officer was extremely knowledgeable about drunk driving investigation. The previous lawyer did nothing for the client except take his money. After Jim was retained, he filed numerous motions, an appeal to the Court of Appeals, and ultimately had a jury trial. The jury came back with a not guilty!

OUTCOME: Case Dismissed

Client charged with driving with an open intoxicant. He was pulled over with an open beer can in the car. The thing was that the officer had no reason to pull the client over and instead made up some ... claim that an unidentified person made a mysterious phone call to the police station to indicate that they had seen the client drinking while driving. Needlesstosay, after I filed our motion to suppress evidence, the prosecutor agreed to dismiss the case.

OUTCOME: All Charges Dismissed

Client charged with Possession of Marijuana after being stopped by the police and illegally searched. Prior attorney strung out case, pushing for the client to become an undercover informant. Mr. Amb ... erg, of the believe that his clients shouldn't be placed into harms way when they are innocent and their rights have been violated, immediately filed a motion do dismiss the case. After holding a hearing where the arresting officer couldn't substantiate how he got his "tip" the client had narcotics, Judge Moiseev dismissed the case and the client went home free. This case is a prime example of the difference between lawyers who care about their clients and lawyers who just want to take your money and plead you guilty.

Client was charged with going 70 mph in a 45 mph zone. After refusing the offer of the prosecutor, a formal hearing was held in which Mr. Amberg cross-examined the Officer and it was revealed that the ... Officer had failed to properly certify his speedometer contrary to Michigan Case Law. Accordingly, after hearing all proofs, Judge Martinez found the Defendant to be not responsible for speeding.

Client was charged with drunk driving and driving while license suspended. Client blew a .010 on the datamaster, admitted drinking 4 beers an hour before, and allegedly failed some of the sobriety tes ... ts given. There were serious questions concerning the validity of the Datamaster machine, as well as a question of whether my client confessed to driving the vehicle. The jury was out for 20-30 minutes and came back with a not guilty verdict!

Client charged with drunk driving OWI DUI OUIL after being stopped for running a red light. Client had a blood alcohol content over twice the legal limit. Jim Amberg filed a motion regarding the sear ... ch warrant and was able to get all evidence of the Client's blood suppressed. Criminal charges were subsequently dismissed.

OUTCOME: Resented from 30-life to 10 years

Client originally represented by other counsel. In a major cocaine conspiracy case, the client received a 30-life sentence. After taking the case over in appeal, Richard Amberg was able to get the ca ... se remanded for a resentence. At the trial level, Mr. Amberg's son Jim Amberg took over the case and was successful in obtaining the client a reduction in his sentence to ten years. The resulting sentence allowed the client to be let out of Federal Prison. This also resulted in a very unhappy US Attorney, who attempted to appeal the sentence. However, Jim Amberg successfully argued the case in the 6th circuit court of appeals and won in the published opinion of United States vs Presley.

In a long and grueling trial, the client was charged with Assault with the Intent to Commit Great Bodily Harm Less than Murder. The client was accused of repeatedly stabbing her former boyfriend. Aft ... er an emotional closing, the Jury came back by finding the Client not guilty of Assault to the major crime of Assault with the Intent to Commit Great Bodily Harm Less than Murder and instead found the client guilty of the lesser included charge of simple assault. The Judge gave the client time served with no probation as a sentence.
