This case was initiated in 2014 in the Federal Court for th Southern District of Texas, due to the negligence and malpractice of an attorney in a civil case in the State of Texas. The case was decid ... ed in 2017, and the Judge ruled that the attorney commited legal malpractice and awarded a $3 million judgment at that time due to the malpractice of the attorney. The case was appealed by Defendants and a 3-member panel of Judges of the Federal Court of Appeals in 2019 ruled that the Judgment as to malpractice stands, but that the damages were incorrectly determined under Texas law. On August 15, 2022, the case then went before a jury trial in federal court in McAllen, Texas. After a two day jury trial, Attorney Francisco Tinoco successfully obtained a jury verdict of $1.2 million dollars. Thanks to the hard and diligent work of Attorney Francisco Tinoco, the presentation of the evidence to the jury, and the arguments to the jury, the jury deliberated for LESS THAN 45 minutes in deciding AGAINST Defendants and deciding to award damages in the amount of $1.2 million dollars due to the negligence of Defendants. In closing arguments, the Defendants' attorneys argued that they had a "slam dunk" case, however, the jury of 12 of Defendants' peers in his community, very easily decided otherwise. The jury quickly decided that the attorney was liable for $1.2 million in damages.
