My client was member of a class of people victimized by a fraudulent "credit repair" company. The company sent its customers a mailer informing them that they would lose their right to a jury trial an ... d would have to submit their fraud claims to an arbitrator selected by the company. When we brought suit in court, the credit repair company sought to compel arbitration. The California Court of Appeal ruled against the credit repair company and in favor of the customer class, holding that the credit repair company could not force members of the plaintiff class to arbitrate their claims against the company.
