Possession of Meth
Jul 23, 2014OUTCOME: The judge granted the motion and dismissed the case. The DA then refiled, and I set for another preliminary hearing and motion to suppress. Again, the judge granted the motion and dismissed the case.
My client was parked in a car minding his own business. A cop drove by and for no reason other than my client "looked suspicious" pulled up behind my client's car, shone his spotlight on him, and bega ... n to approach my client with his flashlight and fully armed with a gun in his holster. He noticed a pipe on my client's back seat and he searched my client's car, finding a small amount of meth. My client was charged with felony possession and being under the influence of a controlled substance. I set the case for preliminary hearing and filed a motion to suppress unlawfully obtained evidence at that hearing.
