Successfully Defended The Harvard Drug Group in False Claims Act Litigation

United States, ex rel Conrad v. Actavis Mid-Atlantic, et al (D. Mass). Won dismissal of a False Claims Act case that alleged The Harvard Drug Group, along with dozens of other drug companies, defraude ... d the US government by causing the Medicaid system to reimburse products without appropriate approval from the US Food and Drug Administration. The plaintiff alleged that hundreds of millions of dollars in claims should never have been paid. The Arent Fox team worked with the other defendants to craft a motion to dismiss that attacked the plaintiff’s ability to pursue the suit under the False Claims Act’s public disclosure bar.
