Pierre Falgout, then age 57, was employed by Burlington Northern Santa Fe Railway Company (BNSF) as a railroad carman. On 4-28-09, as he was working in the company’s yard in Amory, a cross tie gav ... e way when he stepped on it, causing Falgout to twist his knee. The trauma to his knee has caused him to walk with a limp and be unable to perform his duties as a railroad carman. BNSF defended the case arguing the incident did not occur, and that Mr. Falgout had a preexisting injury to that knee which caused the limp, as there were no witnesses to the incident other than Mr. Falgout.
