This was a defense of client charged with six counts of violating Ark.Code. Ann. § 23-64-223 (Repl.2001). Each count alleged that the defendant either diverted or appropriated to her own use insurance ... premium monies in violation of the statute. The defendant was acquitted on two counts, and the jury was unable to reach a decision on the remaining four counts. The State appealed the trial court's decision to allow a jury instruction on "choice of evils" and "entrapment by estoppel." The Supreme Court found in favor of the defendant.
OUTCOME: Successfully challenged defendant's illegal sentence on appeal.
The defendant's probation was revoked at a hearing. At the conclusion of the revocation hearing the trial court announced that the defendant would be given credit for time served; however, the judgme ... nt and commitment order failed to reflect such credit. The appeal successfully argued that the sentence be modified to reflect jail-time credit.
OUTCOME: Successful recovery for contractor client on mechanic's lien claim.
Co-wrote appeal that changed how Arkansas divides proceeds from a foreclosure sale between competing lien claimants.
