OUTCOME: Judgement in favor of the City, our client

Collecting Funds due City from Communications Giant’s Unauthorized Use of Rights of Way. In 2008 Aaron, PLC was retained by the City of New Orleans to serve as a its lead counsel in federal court liti ... gation against AT&T seeking damages for AT&T’s uncompensated use of the City’s rights of way with respect to its delivery of telecommunications services to its New Orleans customers. After two years of discovery and a two day Judge trial the Court ruled in the City’s favor declaring that AT&T had been unjustly enriched through its use of the City’s rights of way. The parties are currently awaiting the Court’s ruling as to the amount of damages due the City of New Orleans.

OUTCOME: Motion for Summary Judgment was granted in favor of the D.A. by the district federal court and by the U.S. Fifth Circuit Court of Appeals.

Appellant Thomas Lee White was misidentified and wrongfully imprisoned for 12 months. He sued, in their official capacities, the criminal sheriff of Orleans Parish; the warden of the Catahoula Correcti ... onal Center; and the district attorney of New Orleans under 42 U.S.C. § 1983, claiming that the imprisonment violated his constitutional rights. The district court denied relief, holding the claim barred by Louisiana's prescriptive period. The U.S. Fifth Circuit Court of Appeals affirmed the decision of the Eastern District of Louisiana.
