In an action brought by the State of Louisiana to remove three minor children from their mother following the fathers incarceration following charges of murder of another minor child. I was able to suc ... cessfully argue that the State failed to meet its burden of proof under ICWA that the biological mother should have the children removed from her despite she not having had seen the children in a substantial amount of time. The court held that the State in fact did not meet its burden of proof and the three minor children were ordered to be reunited with their mother. The State appealed and the appellate court upheld the trial courts ruling.
