If she was disabled when you married her, you should not be ordered to pay periodic spousal support, but you may be ordered to pay interim spousal...

Your subsequent husband can adopt or you can file for sole custody. Without either of those, his rights are equal to yours.

Doesn't matter now if she was emancipated as a minor, because now she is an adult. Hire an adoption attorney.
