Defended appeal of summary judgment by asserting that bill of review was untimely, limitations had run even if discovery rule applied, and no evidence of extrinsic fraud as alleged by Plaintiff.

(Later upheld on appeal when 14th Court expanded Timberwalk to encompass employer/employee relationships as well as property owner/invitee).
