On cross, the probation off ... icer offered inconsistencies about dates and times she spoke to client. Circuit Court judge ruled that client was not in violation.

Client called me after she had been sentenced to jail on a plea of guilty to driving on suspended. I filed a motion to reconsider/vacate the judgement b/c Client's previous counsel had pled her guilty ... to a driving on suspended that was based on a nullity. Her record showed that her license was revoked in another county without authority and it was based on this invalid revocation that she was charged and later pled guilty through counsel. I asked the court to vacate that earlier judgement, the current order and also asked for a new trial. She was released from jail. At the new trial, the commonwealth nolle prossed the case.
OUTCOME: NOT GUILTY
Client represented himself on a 3rd or subsequent DOS and received 6 months in jail. He hired me for the appeal. Client found NOT GUILTY on appeal.
