John Doe was treated at the Washington Hospital Center for HIV. He was seen there by a hospital employee who was a co-worker at his part time job. She gained unauthorized access to his medical records ... and learned of his HIV condition. She then breached patient confidentiality by disclosing his condition to coworkers at the part time job. He was mercilessly harassed at the job. The hospital and the coworker denied all charges against them but a jury disagreed and found against the hospital.
OUTCOME: Judge at trial dismissed the case. But she was reversed on appeal to the DC Circuit Court of Appeals , which , in a published opinion ordered the Ins Co to reinstate his ins and pay his medical bills and legal expenses. ( 919 F.2d 747 (D.C. Cir. 1990))
