OUTCOME: Felony Dismissed. Civil Settlement of $75,000

Sheriff's Department went into the client's home without a warrant. They claimed there were number of exigent circumstances for entering the home without a warrant. During the motion to suppress, throu ... gh my cross examination of the deputy, I showed that the alleged exigent circumstances did not exist. Thus, the warrantless search was determined by the court to be unlawful, and the felony was dismissed. Subsequently, I filed a civil rights lawsuit on behalf of the client for the 4th Amendment violation. The civil case concluded with a $75,000 settlement.

I represented a jockey in a personal injury case for a serious injury he sustained during a race. For the most part, jockeys injured during race can only seek workers' compensation benefits, which limi ... ts the damages because pain and suffering is not recoverable in workers' comp court. The client's previous lawyer believed only a worker's comp claim could be brought and not a personal injury case. I was of the opinion that both could be brought. My theory for the personal injury case was that the ambulance company was negligent in treating the client. The personal injury case was settled out of court.
