The Court rejected the government's argument that the Court did not have jurisdiction because the protester did not have standing to challenge the task order procurement. The Court accepted the definition of procurement from the OFPP Act, which included in "procurement" the government's determination of its needs, giving the protester standing to challenge the brand name determination.
