Wrongful death case. Plaintiff worked as a security guard at Oak Ridge National Laboratory, and while on his way to work, was struck by a trailer that had fallen loose from an oncoming truck and kille ... d. The trailer had come loose from the hitch. Litigation involved claims of negligence against the tractor company for operation of its vehicle, and defective product liability against the manufacturer of the trailer.

Knowles et al v. State of Tennessee

OUTCOME: State maximum verdict of $300,000 per person upheld

Plaintiffs were drivers on opposite sides of a U. S. Highway who approached a State of Tennessee mower working on the median. State workers failed to keep proper lookout and caused equipment to encroa ... ch onto the highway, injuring Ms. Knowles and resulting in the wrongdul death of our client, John Snapp. The case went to trial, resulting in a state maximum verdict for Ms. Knowles and the Snapp family. On appeal, the State tried to overturn the verdict, but was unsuccessful. The State of Tennessee then appealed to the Tennessee Supreme Court, but certiorari was denied. The case is a reported decision found at 49 S.W.3d 330 (Tenn. Ct. App., 2001).
