Over the course of my practice I have represented physicians of nearly every specialty, as well as their practice groups. I have also represented hospitals, rehabilitation facilities, long term care facilities, assisted living facilities, independent senior living communities, mental health facilities, mental health providers, physician assistants, advanced practice nurses, registered nurses, licensed nurses, doctors of podiatry, doctors of osteopathic medicine, doctors of chiropractic medicine, and doctors of ophthalmology. Ihave defended these clients in cases involving the complete spectrum of medical negligence allegations, such as those that involve catastrophic injury or death, failure to diagnose, misdiagnosis, medication errors, nursing errors, surgical errors, anesthesia errors, post-operative complications, labor and delivery, interpretation of diagnostic studies, pathological interpretation, and management of antibiotic therapy, just to name a few.
NURSING HOME AND LONG-TERM CARE DEFENSE
My experience in defending traditional medical malpractice claims naturally led to the development of a practice that also is focused on defending nursing homes and other long-term care facilities. While my medical negligence background provides the ability to analyze and defend the medical issues in nursing home cases, I recognize that there are specific areas of concern for long-term care facilities and nursing homes that significantly differ from those presented in a general negligence and medical malpractice case. Applying this knowledge I have been successful in representing numerous skilled nursing, assisted living, and independent living facilities and routinely defended these clients in cases involving: wrongful death, failure to properly manage/monitor/treat a resident’s condition, medication errors, resident falls, pressure ulcers/stasis ulcers, staffing issues, treatment errors or omissions, use of restraints, use of bedrails, wound care, elopement, failure to follow doctor’s orders, consumer protection act claims, and state regulatory claims.
I have an in-depth understanding of the unique operational issues facing long-term care providers, including the regulatory, litigation and insurance atmosphere in which our clients operate. We defend our long-term care industry clients at every stage, including investigations of hotline complaints and surveyor citations, incident investigations, evidence gathering and ongoing facility evaluations. The combination of experience as a trial attorney and the understanding of the long-term care industry are invaluable in successfully defending clients in this high-dollar litigious climate. Perhaps just as important, I help assist clients in identifying potential quality control issues and work with them closely to provide information about how to avoid future claims, and ultimately lower costs.
I am aware of the potentially significant impact that settlements and adverse verdicts can have on individual healthcare providers and institutions. Accordingly, I am devoted to aggressively defending all claims to provide the best result for our clients. While this may result in an amicable and cost effective resolution of the claim before trial, I have the necessary trial experience to take any case to trial if reaching a settlement is not in the best interests of our client.
