OUTCOME: The Court of Special Appeals ruled in our favor and allowed my client to recover punitive damages.

My client was injured when a dangerous truck in the hands of an unsafe driver crossed the center line on the Washington Beltway and struck my client's car. We learned that the owner of the trucking co ... mpany knew in before this crash that his vehicle was unsafe and that his driver had an untreated medical problem. The trial court refused to allow the jury to award punitive damages, and we appealed.
