Criminal indictment for "failure to call 9-1-1 in a timely manner" of several juvenile correctional officers at a private facility in relation to an incident where a juvenile inmate died while being su ... bjected to non-violent physical restrictions which were endorsed by DSS. The case was originally dismissed by the Circuit Court for Carroll County because the indictment did not constitute a crime of omission. That dismissal resulted in an appeal to the Court of Appeals, where the dismissal was vacated and the matter returned to trial with specific factors for which Defendants could be criminal liable for omissions if proven by the State.
