Early release from jail or probation? If it's probation - then yes. If it's from jail, it depends.

Yes, you could be charged with possession even if he told you to throw it away. Although, that scenario is highly unlikely.

All you can do is plead not guilty and go to trial. You've got a better chance with a lawyer.
