I represented that family of young man killed when his handicapped accessible vehicle ran out of control, then crashed and caught fire. Dwight Boeckman suffered a broken neck shortly after high scho ... ol that left him paralyzed. Dwight overcame a great deal of diversity and, through rehab and sheer determination, was in college and could transport himself using a customized mobility van. Unfortunately, the mobility van modifier failed to use any blueprints or consult with any designers or engineers before altering and modifying the van. The van had serious problems including several instances of accelerating out of control. The van accelerated while Dwight Boeckman was driving. Dwight was forced off of the road and into a telephone pole. The modifier had altered the fuel system and ran nearly 8 feet of fuel filler neck from the gas cap opening to the altered fuel tank. This filler line was ruptured during the crash allowing gas to escape. Dwight survived the initial impact uninjured and was able to speak to passersby who were attempting to rescue him. However, the leaking gasoline caught fire before rescuers were able to pull Dwight from the van and he burned to death. We utilized an MIT engineer and a former Ford Motor Company engineer to identify defects in the van's electronic throttle system and fuel system design. We reach a confidential settlement on behalf of Dwight's family.
